Confidential Information
EXSIF may, in its sole discretion, grant you access to parts

(EXSIF EDOCS and EXSIF’s Tank
Leasing System, more commonly referred to as TLS), via a unique password
or other security device provided to you by EXSIF. The EXSIF
EDOCS and TLS contain
information concerning EXSIF or other third parties which is commercially
sensitive and strictly confidential.
You agree that any access to the EXSIF Intranet is conditional
upon you at all times keeping all information which you access
on the EXSIF
Intranet
in the strictest confidence. You may only use this information and
disclose this
information to such other persons or organizations and for such purpose
as
expressly authorized in writing to you by EXSIF.
You will not disclose
to any third party your unique password or other security
device provided by EXSIF, nor the fact that you have
access
to the EXSIF
Intranet to any third party, unless specifically authorized in
writing to you by EXSIF.
You acknowledge and agree that if you breach
any of your obligations regarding the EXSIF EDOCS and TLS, this
would cause EXSIF or other
third parties
to suffer financial or other loss and damage, and EXSIF or any
other affected third party
is entitled to immediately take whatever action is necessary
(including commencing
proceedings for injunctive relief) as is necessary to protect
its interests and that you will be liable to pay damages, plus all
costs and expenses
(including all legal costs and disbursements on a full indemnity
basis) incurred as
a result of your conduct.
Other Terms
These Terms and this Site are governed by the law in force in
the State of New York, U.S.A and you irrevocably submit to
the non-exclusive
jurisdiction of the courts the State of New York, U.S.A and
courts of appeal from
it, for the determination of any dispute concerning the Terms
or this
Site
If, upon judicial interpretation or construction, any provision
of the Terms is determined to be prohibited or limited by law,
such
provision will be
ineffective to the extent of such prohibition or limitation,
without invalidating the remaining
provisions of the Terms. To this end, the provisions of the
Terms are severable. All rights not expressly granted by EXSIF
under
these Terms
are reserved
to EXSIF.
